The only way that Anthony Clark and Jessica Clark could have sold this house was by providing the water rights and water easements they possessed from using the well on Mary Howell's property. Otherwise no realtor would have listed it, no bank would have financed the home so they had no choice, in fact no one in the family involved with this property or Mary Howell's property had a choice in order to help Anthony Clark and Jessica Clark get rid of the financial responsibility with the mortgage. Now since time has gone by they don't care that they all agreed to give the water rights to the property because none of them are hurting financially with the previous mortgage that was on this home. Even though it is only Anthony and Jessica Clark's signatures on the contract they had to get permission from the rest of the family to give the water and easements rights to the property during the sale.

Waco Garrett established the water rights to this house in 1993. Then Anthony and Jessica Clark used the same water rights starting in 2002 until they had to sell the house to me. I say that because I bought it under a short sale. They were desperate to sale the house to get out from under the loan.
